The Ghana Revenue Authority (GRA) is urging importers to take advantage of its Advance Ruling System, a trade facilitation mechanism designed to provide binding decisions on how goods will be treated by Customs before they are shipped to Ghana.

The system, launched in April 2026 with support from the World Bank Group, allows importers, exporters, customs brokers, and any person with a demonstrable interest in a shipment to apply for a decision on tariff classification and the origin of goods prior to importation.

Speaking on Joy FM’s Super Morning Show on Wednesday, September 23, Ernest Nyarkoh, a Senior Officer at the Tema Collection, explained that the programme gives traders the opportunity to obtain a decision from Customs ahead of time.

“It’s a programme that allows you to come to Customs and tell Customs to issue a decision,” Mr. Nyarkoh said. “If it is binding, then it means that you are certain that the decision that will issue will be the decision that will apply when you go for the process of clearance.”

What the System Covers

The programme currently covers two main areas: tariff classification and rules of origin.

Tariff classification determines the specific customs code — the Harmonized System (HS) code — applicable to a product, which in turn determines the duties and taxes applicable to imported goods. For example, a trader importing honey can apply for an advance ruling by providing details about the product and indicating the HS code they believe applies. Customs then examines the product information and applies the relevant rules before making its decision.

The second area, origin, was described by Mr. Nyarkoh as the “economic nationality” of a product. An advance ruling on origin enables an importer to obtain a decision on how the origin of a product will be treated before the goods arrive, providing greater predictability for import transactions.

Application Process and Eligibility

The system is open to a broad range of traders. Importers, exporters, customs brokers, and “anybody who has the intention of exporting goods from abroad to our country” can apply, Mr. Nyarkoh said. However, the application must be made before the goods are shipped or arrive in Ghana.

Applicants must submit the appropriate application form together with information and documents relating to the goods, including an invoice, bill, packing list, and photographs of the product where applicable. Applications can be submitted by email, post, or physically to the Customs Division Headquarters in Accra, and the GRA is developing an electronic submission portal.

A ruling request may cover up to five products or five issues; more than that requires separate applications. There is no fee to apply. Customs will issue a ruling within 90 days when all documentation is complete, and the decision is binding until overturned by the Commissioner-General.

Reducing Disputes and Improving Clearance

The GRA Commissioner-General, Mr. Anthony Sarpong, said at the system’s launch that the initiative marked “a defining moment in Ghana’s revenue administration” and signalled the Authority’s commitment to modernisation, trade facilitation, and building trust with stakeholders.

The Advance Ruling System seeks to strengthen predictability and improve the trade environment, reduce disputes, improve clearance times, lower compliance costs, and enhance transparency.

“This will reduce disputes, improve efficiency and promote consistency in customs decisions,” Mr. Sarpong said, adding that global evidence showed revenue growth was driven more by improved compliance than strict enforcement.

The initiative forms part of broader reforms within the Customs Division, including the deployment of the Publican AI System to detect high-risk consignments and the continued use of the Integrated Customs Management System (ICUMS). The automation of advance rulings within ICUMS is expected to ensure faster and more consistent service delivery across all entry points.

Context: Port Delays and Regional Competition

The advance ruling system comes amid persistent concerns about clearance delays at Ghana’s ports. World Bank data from early 2026 showed that import clearance in Ghana takes nearly 23 working days, compared to five to eight days in Cameroon. Export clearance averages nine days.

The Importers and Exporters Association of Ghana has warned that the country could lose importers to the Port of Abidjan in Côte d’Ivoire if delays and uncertainty at Ghanaian ports are not urgently addressed.

Tema Port has also faced significant congestion, with cargo volumes surging from 700,000 TEUs in 2020 to 2.7 million in 2025. A recent fact-finding mission found that 70 per cent of containers were undergoing intrusive physical inspections, compared to a global standard of 10 per cent, with a risk classification system heavily skewed toward “Red Lane” consignments identified as a major contributor to delays.

The GRA’s advance ruling programme is seen as one measure to address these challenges by allowing traders to resolve key questions about classification and origin before goods arrive, potentially enabling smoother and faster clearance processes upon arrival.

Alignment with International Standards

The initiative aligns with Ghana’s commitments under the World Trade Organization’s Trade Facilitation Agreement and the World Customs Organization’s Revised Kyoto Convention, which call for simplified, harmonised, and predictable customs procedures.

The World Bank, through its Trade Facilitation Support Programme, supported the development of the system in areas including legal and regulatory strengthening, digital systems development, capacity building, and private sector engagement.

Ghana has also been working to modernise its Customs Laboratory with support from the WCO and the European Union under the HS-Africa Programme, aimed at improving uniform classification of commodities and correct collection of customs duties.

About the Advance Ruling System

An advance ruling is a written decision provided by Customs to an applicant prior to the importation of goods, setting forth how the goods will be treated at the time of importation. It is binding on Customs for future importations by the recipient, provided the goods and circumstances correspond with the information on which the ruling was based.
